These are more important questions than you might think. Delta-8 THC might be federally legal, but it’s still subject to various kinds of rules and regulations.

Can you travel with delta-8 THC?

Just imagine: you’ve got a vacation (or staycation, those are cool too!) coming up and you want to make it especially relaxing. 

Why not bring some delta-8 THC along…right? You’re about to pack a favorite product into your carry-on bag when your thoughts merge into questions:

Fear not, peace-seeker. Delta-8 THC is fully legal on the federal level. As long as your delta-8 THC product is derived from hemp, not cannabis, you should be in the clear. 

In other words, consider the source. Delta-8 THC that’s been sourced from hemp is legal to buy, possess, consume, and travel with. Take it from Canafarma Corp, a canna-friendly legal team: [1]

“Consumers can consider traveling with [hemp-derived] products to be the same as traveling with any other over-the-counter supplements.” 

Even the TSA’s own guidelines state that hemp-derived cannabinoids (including CBD, CBN, and delta-8 THC!) are legal if they contain less than 0.3 percent THC by weight. [2] Their perspective is backed up by the Federal Farm Bill itself, which clearly states that it’s legal to possess and travel with hemp-derived cannabinoids. [3

But there’s a twist: in the US state law trumps federal law…and not every US state is delta-8 friendly. 

Can you take delta-8 THC on a plane?

You can take delta-8 THC on a plane if it’s legal in both a) the state you are departing from and b) the state you are arriving to. 

The following states have banned delta-8 THC. Don’t fly with delta-8 if these states are your starting point or your final destination:

  • North Dakota
  • Rhode Island
  • Washington
  • Mississippi
  • Kentucky
  • New York
  • Delaware
  • Colorado
  • Arkansas
  • Montana
  • Vermont
  • Arizona
  • Alaska
  • Idaho
  • Texas
  • Utah
  • Iowa

If none of these states are on your flight itinerary, you’re good to go! Feel free to bring delta-8 products along for the ride. (You may still want to be careful with delta-8 flower, though, as law enforcement can easily confuse it for less-legal cannabis.)

Can you fly with delta-8 THC gummies? Once again, just as long as the states mentioned above aren’t your point A or point B. 

But we don’t blame you for wondering. The TSA has been a little uppity when it comes to cannabinoids in the past. Some people have even been harassed for traveling with CBD! While the TSA has gotten more progressive since then, it’s still good to err on the side of caution. 

Can you travel with delta-8 THC internationally?

Delta-8 is legal in many Western countries. That being said, you should definitely do your research before bringing delta-8 on any international trips. International rules and regulations are constantly changing!

Can I take delta-8 THC on flights to Canada?

Delta-8 THC is federally legal in Canada. Canadians also tend to be very friendly to cannabis. You’re unlikely to experience any friction if you fly with your delta-8. [4

Can I take delta-8 THC on flights to Mexico?

Mexico legalized all forms of cannabis and hemp in 2021. That means delta-8 THC is A-OK!

Can I take delta-8 Thc on flights to Europe?

Delta-8 THC is illegal in some European countries, particularly Eastern European countries. When in doubt, leave it out of your suitcase. 

Traveling with delta-8 vapes in Africa

Delta-8 THC is illegal in most African countries. It’s legal in South Africa, however. Not surprising considering SA has some of the most forward-thinking cannabis rules in the world. 

Traveling with delta-8 vapes in Asia

Delta-8 THC is illegal in most (possibly all) Asian countries. We wouldn’t recommend you bring something stronger than a CBD topical. 

How to travel safely with delta-8: top tips

Safety is always the best policy when you’re flying with delta-8 THC. Check our above list to make sure your point A or point B aren’t on there. If they’re not on the no-fly list, you’re good to go! And don’t forget to enjoy your trip, of course. Delta-8 should make that easier.
